Property Authority

 

The following sections provide information to prospective applicants on how to obtain authority. The information provided is expected to answer most questions and offer direction to meet most needs. If you have additional questions or need guidance, contacts have been provided.

Application information, Property, except Household Goods, Form RA61

The filing of an application does not allow a carrier to operate. Operations that are started before authority is granted and before a carrier has met with the Department’s compliance requirements may result in the denial of the application and the imposition of civil and/or criminal penalties.

One copy of the completed application must be submitted to the NYS Department of Transportation, OMSS-Motor Carrier Registration Section, 50 Wolf Road-POD 53, Albany, NY 12232, along with a check or money order in the amount of $50.00, made payable to “NYS Department of Transportation,” to cover the filing fee. A $20.00 fee will be charged for all checks returned by the bank.

All questions must be answered completely or “not applicable” entered in response to an inquiry. Any requested paperwork must be attached. Failure to completely answer all questions or any missing paperwork may cause the application to be rejected or cause a delay in processing. The application may be prepared by the applicant’s principal or by a duly authorized representative; however, it must be verified by one of the applicant’s principals.

  1. Authority – Property, except Household GoodsAuthority to operate as a carrier of Property, except Household Goods, may be issued after notice and with or without a hearing to a carrier if it is determined that the carrier is fit, willing and able to hold authority and there are no valid safety protests.

    The application for authority is posted in the Department’s Weekly Bulletin of Motor Carrier Applications, and held for 30 days to allow protests on safety issues only. The applicant is sent a compliance acknowledgement notice. If there are no valid safety protests and the applicant has completed the necessary compliance, the authority will be issued at the end of the 30-day protest period. The applicant is given 90 days to complete the compliance requirements.

    Carriers holding authority will be subject to the continuing requirement of being fit, willing and able to operate. If the carrier fails to maintain this requirement, the Department may suspend or revoke the authority in whole or in part.

    Authority to transport property, except household goods shall not confer any proprietary or property rights in the use of the State highway system.

  2. Compliance – Property, except Household GoodsCompliance requirements for issuance of authority as a property, except household goods are:
    • Evidence of InsuranceLiability Insurance (Form E) – The applicant must file and maintain in effect evidence of liability insurance, which is labeled “Form E.” This form must be filed by the insurance company in the exact name as shown on the approval or grant of authority.     • The NYS Workers’ Compensation Law requires that before authority to operate as a property carrier is issued, an applicant must file, and maintain on file, proof that they have complied with Workers’ Compensation Insurance and Disability Benefits Insurance.  The following forms are the only forms the Department of Transportation will accept:Workers’ Compensation Insurance:
      • Form C-105.2 – obtained from a private NYS licensed insurance carrier.
      • Form U-26.3 – obtained from the NYS Insurance Fund.
      • Form SI-12* – status as self-insured.
      • Form G-SI-12* – status as a member of group self-insurance.
      • Form CE-200 – Certificate of Attestation of Exemption from Workers’ Compensation.  The application can be completed on-line for same day certification on the New York State Workers’ Compensation Board’sweb site. The preceding external link opens a new browser window

      Disability Benefits Insurance

      • Form DB-120.1 – obtained from a private NYS licensed insurance carrier and/or the NYS Insurance Fund.
      • Form DB-155* – Status as self-insured.
      • Form CE-200 – Certificate of Attestation of Exemption from Workers’ Compensation and/or Disability Benefits Coverage.  The application can be completed on-line for same day certification on the New York State Workers’ Compensation Board’s web site.         * These forms are obtained from the Workers’ Compensation Board’s Self Insurance Office. (518) 402-0247.

    NOTE:  All insurance filings must come from an insurance company authorized by the New York State Insurance Department to write such coverage in the State of New York.

    • Vehicle IdentificationEach vehicle operating under intrastate property authority must carry a New York State Intrastate Vehicle Identification Receipt. The fee per vehicle operated is $10.00, and is renewed on a yearly basis. The application for receipts may be obtained by:
    • USDOT NumberAll property carriers applying for intrastate operating authority, regardless of the weight of the vehicle, must have a USDOT number. This may be obtained by:
      • Calling 518-457-6512 and request the application be mailed or faxed to you.
      • Registering online at http://www.fmcsa.dot.gov/ The preceding external link opens a new browser window and click on “Registration & Licensing.” You will need a valid credit card (there is no charge – the card is your electronic signature)
    • Certificate (Property, except Household Goods)
      • Authority to operate as a carrier of property, except household goods by motor vehicle may be issued by the commissioner after notice and with or without hearing to a carrier if the commissioner determines that the holder is fit, willing and able to hold authority and there are no valid safety protests.
      • The application for authority is posted in the Department’s Weekly Bulletin. Protests may only be filed on safety matters and must be filed within 30 days of the date of posting in the Weekly Bulletin. If no valid safety protests are submitted and the carrier has filed the required compliance requirements, the certificate will be issued within 5 days. (Assuming that the 30-day period for publication in the Weekly Bulletin has expired.)
      • Persons holding authority will be subject to a continuing requirement of being fit, willing and able and if, after notice and hearing, the commissioner finds that any person holding authority is willfully failing to comply with the continuing fit, willing and able requirement the commissioner may suspend or revoke the authority in whole or in part.
      • Authority to transport property shall not confer any proprietary or property rights in the use of the highways.
